The appeal from the judgment of the Federal Court of Appeal, Number A-184-11, 2012 FCA 92, dated March 16, 2012, heard on November 4, 2013, is dismissed without costs on the appeal and on the application for leave to appeal.  Rothstein and Moldaver JJ. are dissenting in part.

 

L’appel interjeté contre l’arrêt de la Cour d’appel fédérale, numéro A-184-11, 2012 CAF 92, en date du 16 mars 2012, entendu le 4 novembre 2013, est rejeté sans dépens quant à l’appel et à la demande d’autorisation d’appel.  Les juges Rothstein et Moldaver sont dissidents en partie.
