The appeal from the judgment of the Court of Appeal of Alberta (Edmonton), Number 1203-0178-AC, 2013 ABCA 98, dated March 18, 2013, heard on February 12, 2014, is allowed in part. The appeal with respect to Canadian American Financial Corp. (Canada) Limited is allowed. The trial judge’s assessment of damages is varied to $87,000 plus interest. Mr. Bhasin should have his costs throughout as against Canadian American Financial Corp. (Canada) Limited. The appeal with respect to Mr. Hrynew is dismissed. There should be no costs at any level in favour of or against Mr. Hrynew.
L’appel interjeté contre l’arrêt de la Cour d’appel de l’Alberta (Edmonton), numéro 1203-0178-AC, 2013 ABCA 98, en date du 18 mars 2013, entendu le 12 février 2014, est accueilli en partie. L’appel en ce qui concerne Canadian American Financial Corp. (Canada) Limited est accueilli. L’appréciation des dommages-intérêts faite par la juge de première instance est modifiée et fixée à 87 000 $ plus l’intérêt. M. Bhasin a droit à ses dépens dans toutes les cours à l’encontre de Canadian American Financial Corp. (Canada) Limited. L’appel est rejeté en ce qui concerne M. Hrynew. Aucuns dépens ne sont adjugés à M. Hrynew ou à son encontre devant aucune des instances.
