L’appel interjeté contre l’arrêt de la Cour d’appel de la Colombie-Britannique (Vancouver), numéro CA039032, 2012 BCCA 397, en date du 9 octobre 2012, entendu le 22 avril 2014, est rejeté.  Les juges Abella, Cromwell et Karakatsanis sont dissidents.
