The appeal from the judgment of the Federal Court of Appeal, Number A-348-09, 2010 FCA 196, dated July 21, 2010, heard on December 12, 2011, is allowed and the matter is remitted to the Minister for redetermination. Costs are awarded to the appellant throughout.
