The appeal from the judgment of the Federal Court of Appeal, Number A-312-13, 2015 FCA 17, dated January 22, 2015, heard on January 19, 2016, is allowed with costs throughout. The decision of the Adjudicator is restored. Moldaver, Côté and Brown JJ. are dissenting.
L’appel interjeté contre l’arrêt de la Cour d’appel fédérale, numéro A-312-13, 2015 CAF 17, daté du 22 janvier 2015, entendu le 19 janvier 2016, est accueilli avec dépens devant toutes les cours. La décision de l’arbitre est rétablie. Les juges Moldaver, Côté et Brown sont dissidents.
