The appeal from the judgment of the Federal Court of Appeal, Number A-65-13, 2014 FCA 266, dated November 17, 2014, heard on March 29, 2016, is allowed and the decision of the Canadian International Trade Tribunal is restored. The appellant is entitled to costs in this Court and at the Federal Court of Appeal. Côté J. is dissenting.
L’appel interjeté contre l’arrêt de la Cour d’appel fédérale, numéro A-65-13, 2014 CAF 266, daté du 17 novembre 2014, entendu le 29 mars 2016, est accueilli et la décision du Tribunal canadien du commerce extérieur est rétablie. L’appelant a droit aux dépens devant notre Cour et devant la Cour d’appel fédérale. La juge Côté est dissidente.
