1 L'Heureux‑Dubé J. ‑‑ This is an appeal as of right. The majority of the Court would dismiss the appeal substantially for the reasons of the majority of the Court of Appeal. Justice L'Heureux‑Dubé would have allowed the appeal for the reasons of Abella J.A. dissenting in the Court of Appeal. Accordingly the appeal is dismissed.
