                   APPEAL from a judgment of the Manitoba Court of Appeal (1987), 44 Man. R. (2d) 275, 39 D.L.R. (4th) 54, allowing an appeal from the appellant's acquittal on charges under s. 38 of the Combines Investigation Act, and ordering a new trial. Appeal dismissed.

1.                       The Chief Justice‑‑There is no need to hear you Mr. Fainstein. Justice Lamer will give judgment for the Court.

 

2.                       Lamer J.‑‑This appeal comes to us as of right. Applying to the facts of this case the principles laid down by this Court in R. v. Collins, [1987] 1 S.C.R. 265, R. v. Sieben, [1987] 1 S.C.R. 295, R. v. Hamill, [1987] 1 S.C.R. 301, we find no error in the court below in exercising its jurisdiction to review the judge's finding under s. 24(2)  of the Canadian Charter of Rights and Freedoms .

 

3.                The appeal is dismissed.

 

                   Judgment accordingly.
