                   APPEAL from a judgment of the Federal Court of Appeal, [1983] 1 F.C. 1005n, 45 N.R. 549, 143 D.L.R. (3d) 264, allowing an appeal from a decision of the Railway Transport Committee of the Canadian Transport Commission.  Appeal allowed.

1.                       The Chief Justice ‑‑ Pursuant to s. 75 of the Supreme Court Act, R.C.S. 1970, c. S‑19, the appeal is allowed, the decision of the Federal Court of Appeal pronounced on December 9, 1982 ([1983] 1 F.C. 1005n, 45 N.R. 549, 143 D.L.R. (3d) 264) id set aside and the decision of the Railway Transport Committee of the Canadian Transport Commission, dated October 23, 1981, is allowed.
