Supreme Court of Canada

Expropriation—Municipal by-law—Vested rights—Number of zones—Indemnity determined by Public Service Board—Homologation by Superior Court—Indemnity upheld.

APPEAL from a judgment of the Court of Appeal of Quebec, affirming a judgment of the Superior Court. Appeal dismissed.

Guy Marcotte, for the appellants.

Louis Vézina and Michèle Lacroix, for the respondent.

English version of the judgment of the Court delivered orally by

DICKSON J.—It will not be necessary to call upon you Mr. Vézina or Ms. Lacroix. We are not persuaded that there is, in any of the grounds of appeal advanced on behalf of the appellants, a basis for intervention by this Court with respect to the award made by the Public Service Board or a basis for referring the matter to the Expropriation Tribunal with a view to varying the award. The appeal is accordingly dismissed with costs.

Judgment accordingly.

Solicitors for the appellants: Gilbert, Magnan, Marcotte, Tremblay & Forget, Montreal.

Solicitors for the respondent: Vézina, Pouliot & Associates, Ste-Foy.
