Criminal law ‑‑ Impaired driving ‑‑ Care or control of a motor vehicle ‑‑ Whether the offence of having care or control of a motor vehicle with a blood alcohol level of over .08 is included in the offence of driving a motor vehicle with a blood alcohol level of over .08.
APPEAL from a judgment of the Quebec Court of Appeal (1988), 14 M.V.R. (2d) 50, 20 Q.A.C. 94, dismissing the accused's appeal from a judgment of the Superior Court[1], affirming the judgment of the Court of Sessions of the Peace[2], convicting the accused of having care or control of a motor vehicle while his blood alcohol level exceeded .08 contrary to s. 236 of the Criminal Code. Appeal dismissed.
