JUDGMENT

The motion for extension of time to serve and file the application for leave to appeal is granted.  The applications for leave to appeal and to cross-appeal from the judgment of the Court of Appeal for Ontario, Number C57131, 2015 ONCA 158, dated March 13, 2015, are granted without costs.  The appeal and the cross-appeal are to be heard with Anita Endean, as representative plaintiff v. Her Majesty the Queen in Right of the Province of British Columbia, et al. (35843). The parties are invited to file, within fifteen (15) days of the granting of leave, written submissions of not more than ten (10) pages regarding the role and status of Fund Counsel for Ontario, and in particular whether it should be an appellant rather than a respondent.

JUGEMENT

La requête en prorogation du délai de signification et de dépôt de la demande d’autorisation d’appel est accueillie. Les demandes d’autorisation d’appel et d’appel incident de l’arrêt de la Cour d’appel de l’Ontario, numéro C57131, 2015 ONCA 158, daté du 13 mars 2015, sont accueillies sans dépens. L’appel et l’appel incident seront entendus avec Anita Endean, en sa qualité de représentante des demandeurs c. Sa Majesté la Reine du chef de la province de la Colombie-Britannique, et al. (35843). Les parties sont invitées à déposer dans les quinze (15) jours de l’autorisation d’appel des observations écrites d’au plus dix (10) pages quant au rôle et statut du Fund Counsel for Ontario, notamment quant à savoir si ce dernier devrait être appelant plutôt qu’intimé.
