Subscriptions may be had at $200 per year, payable in advance, in accordance with the Court tariff.  During Court sessions it is usually issued weekly.

 

Le prix de l'abonnement, fixé dans le tarif de la Cour, est de 200 $ l'an, payable d'avance.  Le Bulletin paraît en principe toutes les semaines pendant les sessions de la Cour.


 

 

 


 


The Bulletin, being a factual report of recorded proceedings, is produced in the language of record.  Where a judgment has been rendered, requests for copies should be made to the Registrar, with a remittance of $10 for each set of reasons.  All remittances should be made payable to the Receiver General for Canada.

 

Le Bulletin rassemble les procédures devant la Cour dans la langue du dossier.  Quand un arrêt est rendu, on peut se procurer les motifs de jugement en adressant sa demande au registraire, accompagnée de 10 $ par exemplaire.  Le paiement doit être fait à l'ordre du Receveur général du Canada.

Criminal law - Appeal - Procedure - Judgments and Orders - Whether the Court of Appeal exceeded its jurisdiction by ordering, pursuant to s. 686(8)  of the Criminal Code , that the Appellant’s new trial be confined to the issue of whether the Appellant is guilty of second degree murder or manslaughter - If the Court of Appeal had jurisdiction to make such an order, whether it erred in concluding that the circumstances of this case were sufficiently exceptional to warrant making it - Whether the Court of Appeal erred in considering an affidavit filed by the Crown relating to exhibit destruction in the  absence of an application to adduce fresh evidence - Whether the restricted new trial ordered by the Court of Appeal violates the Appellant’s Charter rights.

Droit criminel - Appel - Procédure - Jugements et ordonnances - La Cour d'appel a-t-elle outrepassé sa compétence en ordonnant, en vertu du par. 686(8)  du Code criminel , que le nouveau procès de l'appelant se limite à la question de savoir si l'appelant est coupable de meurtre au deuxième degré ou d'homicide involontaire coupable? - Si la Cour d'appel avait compétence pour rendre pareille ordonnance, a-t-elle commis une erreur en concluant que les circonstances de l'espèce étaient suffisamment exceptionnelles pour justifier son prononcé? - La Cour d'appel a‐t‐elle commis une erreur en prenant en considération un affidavit déposé par le ministère public relativement à la destruction de pièces en l'absence d'une demande de production d'éléments de preuve nouveaux? - Le nouveau procès restreint ordonné par la Cour d'appel porte-t-il atteinte aux droits que la Charte garantit à l'appelant?

Maritime law - Shipping - Jurisdiction - Limitation of actions - prescription - Does the Ontario Court (General Division) have concurrent original jurisdiction with the Federal Court in claims for wrongful death brought pursuant to s. 646 in Part XIV of the Canada Shipping Act , R.S.C. 1985, c.S-9  - Did the Court of Appeal err when it decided that certain parts of provincial legislation applied to supplement the provisions of the Canada Shipping Act  - Whether the limitation period in s.649  of the Canada Shipping Act  can be extended at the discretion of a court.

The motion brought by the respondent’s Crown to strike out paragraphs 3 to 24 of the appellant’s factum must be granted since they do not deal with the legal issues raised in the dissent of Berger J.A.  As a result there is no appeal before us arising from the issue of law raised in the dissent.

The appellant (respondent in the motion) now seeks leave to appeal on the matters that were raised in the factum in paragraphs 3 to 24.  However, the appellant had been informed in the Order made by Justice L’Heureux-Dubé that leave would be required to present that argument and leave was not sought.


L’appelant (intimé à la requête) sollicite maintenant l’autorisation d’appeler à l’égard des questions soulevées dans le mémoire, aux paragraphes 3 à 24.  Toutefois, l’appelant avait été informé dans l’ordonnance rendue par le juge L’Heureux‐Dubé indiquant qu’il serait nécessaire de demander l’autorisation de présenter cet argument, ce qui n’a pas été fait.

 


At this late stage there is nothing further that the court can do and the appeal is therefore dismissed.
