Torts - Liability - Corporation sole - Sexual assaults by priest - Whether the Supreme Court of Newfoundland and Labrador, Court of Appeal erred in imposing direct liability upon the Roman Catholic Episcopal Corporation of St. George’s in respect of certain sexual assaults upon the Respondents - Whether the Court of Appeal erred in failing to hold the defendant Roman Catholic Church, an unincorporated association, vicariously liable for the acts of the priest - If the Appellant succeeds with its appeal, than are any other of the Respondents on Cross-Appeal liable to the Respondents?
Kevin Bennett, between 1961 and 1989, was Roman Catholic priest in the diocese of St. George’s, Newfoundland. During that time, by his own admission, he committed sexual assault on all 36 of the Respondents (“victims”) who commenced civil actions against him and the other defendants. At trial, Bennett was found liable to the Respondents for the intentional tort of sexual assault. The second defendant, Alphonsus Penney was not found to be vicariously liable for Bennett’s intentional torts but was liable in negligence to the Respondents who were sexually assaulted by Bennett after September 28, 1979. The actions against the third defendant, James MacDonald and the fifth defendant, the Roman Catholic Episcopal Corporation of St. John’s (“St. John’s”) were dismissed. The fourth defendant, Raymond Lahey as successor to Bishop McGrath and the sixth defendant, the Roman Catholic Episcopal Corporation of St. George’s (“St. George’s”) were found vicariously liable to all of the Respondents. Finally, no finding of liability against the Roman Catholic Church was found.
On appeal, all claims of personal liability were dismissed. The findings of personal liability against Archbishop Penney and Bishop Lahey were set aside. The trial judge’s dismissal of the actions against Archbishop MacDonald and the Roman Catholic Episcopal Corporation of St. John’s were upheld, as was the finding that there was no basis to impose liability on the Roman Catholic Church. Lastly, the Roman Catholic Episcopal Corporation of St. George’s was found directly liable, but the trial judge’s finding of vicarious liability was set aside.

Délits civils- Responsabilité - Agressions sexuelles commises par un prêtre- Est-ce que la Cour d’appel de Terre-Neuve-et-Labrador a commis une erreur en décidant que la Roman Catholic Episcopal Corporation of St. George’s avait encouru une responsabilité délictuelle pour certains des actes d’agression sexuelle dont avaient été victimes les intimés ? - Est-ce que la Cour d’appel a commis une erreur en ne tenant pas l’Église catholique, qui est une association non constituée en personne morale, responsable du fait d’autrui pour les agressions commises par le prêtre ?- Si le pourvoi principal était accueilli, il faudrait décider si les autres intimés dans le pourvoi incident ont encouru une responsabilité envers les intimés dans le pourvoi principal.
Kevin Bennett, prêtre de 1961 à 1989 dans le diocèse de St. George’s, Terre-Neuve, admet y avoir commis des actes d’agression sexuelle contre les 36 intimés qui ont intenté des actions civiles contre lui et d’autres défendeurs. Selon le tribunal de première instance, Bennett est responsable envers les défendeurs des délits intentionnels d’agression sexuelle qu’il a commis. Le tribunal a décidé que Alphonsus Penney, le deuxième défendeur, n’était pas responsable du fait d’autrui pour les délits intentionnels de Bennett, mais qu’il encourait une responsabilité délictuelle envers les intimés pour avoir preuve de négligence en ce qui a trait aux actes d’agression sexuelle commis contre eux par Bennett après le 28 septembre 1979. Les actions intentées contre le troisième défendeur, James MacDonald, et le cinquième défendeur, la Roman Catholic Episcopal Corporation of St. John’s ont été rejetées. Selon le premier juge, le quatrième défendeur, l’évêque Raymond Lahey, qui avait succédé à l’évêque McGrath, et le sixième défendeur, la Roman Catholic Episcopal Corporation of St. George’s, étaient responsables du fait d’autrui pour tous les actes d’agression sexuelle que les intimés ont subis. Le tribunal de première instance a jugé que l’Église catholique n’avait pas encouru de responsabilité dans cette affaire.
La Cour d’appel a rejeté toutes les demandes de responsabilité intentées contre les défendeurs à titre personnel. Les conclusions portant que l’archevêque Penney et l’évêque Lahey étaient responsables à titre personnel ont été annulées. Le rejet par le juge de première instance des actions intentées par les intimés contre l’archevêque MacDonald et la Roman Catholic Episcopal Corporation of St. John’s a été confirmé. De même, la Cour d’appel confirmait la décision du premier juge qu’il n’y avait pas de fondement au recours en responsabilité contre l’Église catholique. La Cour d’appel a décidé que la Roman Catholic Episcopal Corporation of St. George’s avait encouru une responsabilité délictuelle de son propre fait, mais elle a infirmé la décision du premier tribunal qui avait conclu à sa responsabilité délictuelle du fait d’autrui.
