The appeal from the judgment of the Court of Appeal for British Columbia (Vancouver), Number CA031247, 2004 BCCA 422, dated August 3, 2004, heard on February 15, 2006 is dismissed without costs, save and except that the respondent is entitled to be reimbursed for her actual out-of-pocket expenses incurred to respond to the appeal in this Court.
L’appel interjeté contre l’arrêt de la Cour d’appel de la Colombie‑Britannique (Vancouver), numéro CA031247, 2004 BCCA 422, en date du 3 août 2004, entendu le 15 février 2006 est rejeté sans dépens, l’intimée ayant toutefois droit au remboursement des dépenses qu’elle a engagées pour contester l’appel interjeté devant notre Cour.
