Coram: McLachlin C.J. and Bastarache, Binnie, Deschamps, Fish, Abella and Charron JJ.

The appeal from the judgment of the Court of Appeal for British Columbia (Vancouver), Numbers CA029851 and CA029852, 2004 BCCA 121, dated March 4, 2004, heard on October 14, 2005, is allowed, the convictions are set aside and acquittals are entered. McLachlin C.J. and Bastarache and Fish JJ. are dissenting.

L’appel interjeté contre l’arrêt de la Cour d’appel de la Colombie‑Britannique (Vancouver), numéros CA029851 et CA029852, 2004 BCCA 121, en date du 4 mars 2004, entendu le 14 octobre 2005, est accueilli, les déclarations de culpabilité sont annulées et des acquittements sont inscrits. La juge en chef McLachlin et les juges Bastarache et Fish sont dissidents.
