L’appel interjeté contre l’arrêt de la Cour d’appel de l’Ontario, numéro C40652, en date du 26 septembre 2005, entendu le 10 novembre 2006, est rejeté avec dépens. L’appel incident est rejeté, les juges Bastarache, Charron et Rothstein sont dissidents.
