The appeal from the judgment of the Nova Scotia Court of Appeal, Number CA330605, 2011 NSCA 26, dated March 4, 2011, heard on May 10, 2012, is allowed in part to permit A.B. to proceed anonymously with her application for disclosure of the identity of the relevant IP user(s). The lower courts’ costs orders are set aside and no costs are awarded in this Court.
L’appel interjeté contre l’arrêt de la Cour d’appel de la Nouvelle-Écosse, numéro CA330605, 2011 NSCA 26, en date du 4 mars 2011, entendu le 10 mai 2012 est accueilli en partie afin de permettre à A.B. de procéder de façon anonyme dans le cadre de sa demande d’une ordonnance obligeant la divulgation de l’identité de l’utilisateur ou des utilisateurs de l’adresse IP. Les ordonnances relatives aux dépens rendues dans les instances inférieures sont annulées et les dépens ne sont pas octroyés dans notre Cour.
