The appeal from the judgment of the Court of Appeal for Ontario, Number C54968, 2014 ONCA 178, dated March 7, 2014, was heard on November 14, 2014, and the Court on November 20, 2014, delivered the following judgment:
ROTHSTEIN J. — The majority of the Court is of the view that the appeal should be dismissed for the reasons of Doherty J.A. in the Court of Appeal. Justices Cromwell and Karakatsanis, dissenting, would have allowed the appeal for the reasons of Pepall J.A.
L’appel interjeté contre l’arrêt de la Cour d’appel de l’Ontario, numéro C54968, 2014 ONCA 178, daté du 7 mars 2014, a été entendu le 14 novembre 2014, et la Cour a prononcé le jugement suivant le 20 novembre 2014 :
LE JUGE ROTHSTEIN — La majorité de la Cour est d’avis de rejeter le pourvoi pour les motifs exposés par le juge Doherty de la Cour d’appel. Les juges Cromwell et Karakatsanis, dissidents, auraient accueilli le pourvoi pour les motifs de la juge d’appel Pepall.
