L’appel interjeté contre l’arrêt de la Cour d’appel de l’Alberta (Edmonton), numéro 1403-0001-AC, 2015 ABCA 225, daté du 30 juin 2015, entendu le 9 décembre 2016, est rejeté avec dépens en faveur d’Elk Valley Coal Corporation, Cardinal River Operations. Le juge Gascon est dissident.
