JUGEMENT
Une audience de justification a été tenue ce jour et le jugement se lit comme suit :
Le juge Gonthier : (oralement)
Vu l’adoption de l’article 535.1 du Code civil postérieurement à la permission d’appel, la question de droit faisant l’objet de cette permission n’est plus d’importance générale et ne justifie pas son maintien. Pour ce motif, la permission d’appel est retirée et est déclarée sans effet.
Les questions en litige y compris celle se rapportant à l’adoption de l’article 535.1 restent de la compétence de la cour supérieure.
JUDGMENT
A show cause hearing was held today and the judgment reads as follows:
Gonthier J. : (orally)
In view of the enactment of article 535.1 of the Civil Code after leave to appeal was granted, the question of law for which leave was granted is no longer of general importance and does not justify its maintenance. For this reason leave to appeal is withdrawn and is declared to be of no effect.
The issues including the one concerning the enactment of article 535.1 remain within the Superior Court’s jurisdiction.
