28899 - 28903  Billy Taillefer c. Sa Majesté la Reine ‑ et entre ‑ Hugues Duguay c. Sa Majesté la Reine (Crim.) (Qué.) 2003 SCC 70 / 2003 CSC 70

 

Coram :               La juge en chef McLachlin et les juges Gonthier, Iacobucci, Major, Bastarache, Binnie, Arbour, LeBel et Deschamps

 

Les appels interjetés contre les arrêts de la Cour d’appel du Québec (Québec), numéros 200‑10‑001107‑007 et  200-10-000855-994, en date du 10 septembre 2001, entendus le 22 janvier 2003, sont accueillis.

 

Dans le dossier Taillefer (28899), la condamnation est annulée et la tenue d’un nouveau procès sur une accusation de meurtre au premier degré est ordonnée.

 

Dans le dossier Duguay (28903),  le retrait du plaidoyer de culpabilité est accordé, la condamnation est annulée et un arrêt des procédures est prononcé.

 

 

The appeals from the judgments of the Court of Appeal of Quebec (Québec), Numbers 200‑10‑001107‑007 and 200-10-000855-994, dated September 10, 2001,  heard on  January 22, 2003 are allowed.

 

In the case of Taillefer (28899), the conviction is quashed and a new trial is ordered to be held on a charge of first degree murder.

 

In the case of Duguay (28903), leave to withdraw the guilty plea is granted, the conviction is quashed and a stay of proceedings is directed.

 

 


28988 - 28981  Her Majesty the Queen in Right of the Province of British Columbia, as represented by the Minister of Forests v. Chief Dan Wilson, in his personal capacity and as representative of the Okanagan Indian Band and all other persons engaged in the cutting, damaging or destroying of Crown Timber at Timber Sale Licence A57614 and Attorney General of Canada, Attorney General of Ontario,  Attorney General of Quebec, Attorney General of New Brunswick, Attorney General of British Columbia, Attorney General of Alberta, the Songhees Indian Band, the T'Sou‑ke First Nation, the Nanoose First Nation and the Beecher Bay Indian Band (collectively the "Te'mexw Nations"), and Chief Roger William, on his own behalf and on behalf of all other members of the Xeni Gwet'in First Nations government and on behalf of all other members of the Tsilhqot'in Nation ‑ and between ‑ Her Majesty the Queen in Right of the Province of British Columbia, as represented by the Minister of Forests v. Chief Ronnie Jules, in his personal capacity and as representative of the Adams Lake Indian Band, Chief Stuart Lee, in his personal capacity and as representative of the Spallumcheen Indian Band, Chief Arthur Manuel, in his personal capacity and as representative of the Neskonlith Indian Band, and David Anthony Nordquist, in his personal capacity and as representative of the Adams Lake Indian Band, the Spallumcheen Indian Band, and the Neskonlith Indian Band and all other persons engaged in the cutting, damaging or destroying of Crown Timber at Timber Sale Licence A38029, Block 2 and Attorney General of Canada, Attorney General of Ontario, Attorney General of Quebec, Attorney General of New Brunswick, Attorney General of British Columbia, Attorney General of Alberta,    the Songhees Indian Band, the T'Sou‑ke First Nation, the Nanoose First Nation and the Beecher Bay Indian (collectively the "Te'mexw Nations"), and Chief Roger William, on his own behalf and on behalf of all other members of the Xeni Gwet'in First Nations government and on behalf of all other members of the Tsilhqot'in Nation (B.C.) 2003 SCC 71 / 2003 CSC 71

The appeal from the judgment of the Court of Appeal for British Columbia (Vancouver), Numbers CA27594 and CA27595, dated November 5, 2001, heard on June 9, 2003 is dismissed with costs, Iacobucci, Major and Bastarache JJ. dissenting.

 

L’appel interjeté contre l'arrêt de la Cour d'appel de la Colombie‑Britannique (Vancouver), numéros CA27594 et  CA27595, en date du 5 novembre 2001, entendu le 9 juin 2003 est rejeté avec dépens.  Les juges Iacobucci, Major et Bastarache sont dissidents.
