The Crown’s appeal from the judgment of the Court of Appeal of British Columbia (Vancouver), Number CA027999, dated February 27, 2002, and August 19, 2002, heard on March 24, 2004, is dismissed. Weyerhaeuser’s appeal is allowed. The Attorney General of British Columbia will pay the costs of the respondents. Weyerhaeuser is relieved of any obligation to pay the costs of the respondents in the courts below.
L’appel de la Couronne interjeté contre l’arrêt de la Cour d’appel de la Colombie‑Britannique (Vancouver), numéro CA027999, en date du 27 février 2002 et du 19 août 2002, entendu le 24 mars 2004, est rejeté. L’appel de Weyerhaeuser est accueilli. Le procureur général de la Colombie-Britannique acquittera les dépens des intimés. Weyerhaeuser est dispensée de toute obligation de payer les dépens des intimés devant les instances inférieures.

The appeal from the judgments of the Court of Appeal of British Columbia (Vancouver), Numbers CA027488 and CA027500, dated January 31, 2002, heard on March 24, 2004 is allowed. Leave to appeal was granted on terms that the appellants pay the party and party costs of the respondents, Taku River Tlingit First Nation and Melvin Jack, on behalf of himself and all other members of the Taku River Tlingit First Nation, for the application for leave to appeal and for the appeal in any event of the cause. There is no order as to costs with respect to the respondents Redfern Resources Ltd. and Redcorp Ventures Ltd.
L’appel interjeté contre les arrêts de la Cour d’appel de la Colombie‑Britannique (Vancouver), numéros CA027488 et CA027500, en date du 31 janvier 2002, entendu le 24 mars 2004, est accueilli. L’autorisation d’appel a été accordée à la condition que les appelants paient, sur la base partie-partie, les dépens des intimés Première nation Tlingit de Taku River et Melvin Jack, en son propre nom et au nom de tous les autres membres de la Première nation Tlingit de Taku River, pour la demande d’autorisation d’appel et pour l’appel. Aucune ordonnance relative aux dépens n’est rendue à l’égard des intimées Redfern Resources Ltd. et Redcorp Ventures Ltd.
