OTTAWA, April 9, 2008 - The Rt. Hon. Beverley McLachlin, Chief Justice of Canada, announced today that Justice Michel Bastarache has written to the Minister of Justice, the Honourable Robert Nicholson, to advise that he will retire at the end of the spring session of the Court, effective June 30, 2008. “Justice Bastarache has served on the Court with wisdom, and made enormous contributions to the Court and to Canada. He is a valued colleague and a friend, who will be missed by all the members of the Court”, said the Chief Justice.
For his part, Justice Bastarache said, “It is a great honour and privilege to be asked to be a member of the Supreme Court of Canada. There are but a small number of jurists who have had the opportunity to serve their country in this capacity, and to have had the chance to participate so directly in the development of the law. I am extremely grateful for the privilege of serving as a member of the Court.”
Justice Bastarache was appointed to the Supreme Court of Canada in September 1997, after serving on the New Brunswick Court of Appeal.
“I know that the Canadian Government will consider the appointment of a new justice with the care and deliberation required”, Chief Justice McLachlin added. “I am hopeful that the appointment will be made in time for the fall session of the Court, in October 2008.”

OTTAWA, le 9 avril 2008 - La très honorable Beverley McLachlin, Juge en chef du Canada, a annoncé aujourd’hui que M. le juge Bastarache a écrit au ministre de la Justice, l’honorable Robert Nicholson, pour l’aviser qu’il prenait sa retraite à la fin de la session de printemps de la Cour, le 30 juin 2008. “M. le juge Bastarache a servi comme juge de la Cour avec sagesse et a fait d’énormes contributions à la Cour et au Canada. C’est un collègue estimé et un ami qui va manquer à tous les membres de la Cour”, a déclaré la Juge en chef.
M. le juge Bastarache a pour sa part déclaré que “C’est un grand honneur et un privilège d’avoir été appelé à siéger à la Cour suprême du Canada. Il n’y a qu’un nombre infime de juristes qui ont l’occasion de servir leur pays à ce titre et qui ont la chance de participer directement au développement du droit. Je suis extrêmement reconnaissant d’avoir eu le privilège de servir en tant que juge de la Cour”.
M. le juge Bastarache a été nommé à la Cour suprême du Canada en septembre 1997, après avoir été juge à la Cour d’appel du Nouveau-Brunswick.
“Je sais que le gouvernement canadien se penchera sur la nomination d’un nouveau juge avec le soin et les délibérations nécessaires” a ajouté la juge en chef McLachlin. “J’espère que la nomination sera faite à temps pour la session d’automne de la Cour, en octobre 2008".
