Criminal law - Appeals - Jurisdiction - Extension of time - Whether the Court of Appeal erred in law by allowing an appeal from the decision of a single judge of the same court, denying an extension of time under s.678(2) of the Criminal Code.
In November 1999, the Respondent was charged with 32 counts of historical sexual offences which were allegedly committed between 1958 and 1965. Trial proceeded with respect to 17 counts in 2000 and the Respondent was ultimately sentenced to two years less one day imprisonment on two convictions. The Respondent sought leave to extend the time to serve and file a notice of appeal against conviction 8.5 years later. The proposed ground of appeal was alleged ineffectiveness of counsel and a proposal to tender fresh evidence.

Droit criminel - Appels - Compétence - Prorogation de délai - La Cour d’appel a-t-elle commis une erreur de droit en accueillant l’appel de la décision d’un juge de la même cour, siégeant seul, refusant une prorogation de délai demandée en application du par. 678(2) du Code criminel?
En novembre 1999, l’intimé a été accusé sous 32 chefs pour d’anciennes infractions sexuelles qui auraient été commises entre 1958 et 1965. Le procès a eu lieu relativement à 17 chefs en 2000. L’intimé a finalement été condamné à une peine d’emprisonnement de deux ans moins un jour pour deux chefs dont il a été déclaré coupable. Il a demandé une autorisation de prorogation du délai de signification et de dépôt d’un avis d’appel de la déclaration de culpabilité 8 ans et demi plus tard. Le moyen d’appel invoqué était l’inefficacité de son avocat et l’existence de nouveaux éléments de preuve.
