L’appel interjeté contre l’arrêt de la Cour d’appel fédérale, numéro A-113-10, 2011 CAF 64, en date du 28 février 2011, entendu le 17 avril 2012, est accueilli avec dépens devant toutes les cours. Les juges Deschamps, Abella, Cromwell et Karakatsanis sont dissidents.
