Mr. Febles is a Cuban citizen who was granted refugee status in the United States due to his fear of persecution as a political dissident. While in the U.S., he was twice convicted of assault with a deadly weapon. As a result of those convictions, he was subject to removal from the U.S. after having served his sentences. Shortly after his release from prison, Mr. Febles entered Canada illegally and claimed refugee status.
Before the Refugee Protection Division of the Immigration and Refugee Board (the Board), Mr. Febles argued that he had served his sentences, posed no danger to Canadian society and was now rehabilitated. The Board dismissed his claim for refugee status. It held that it was bound by the legislation (s. 98 of the Immigration and Refugee Protection Act and Article 1F(b) of the United Nations Convention relating to the Status of Refugees) and jurisprudence according to which a person who has been convicted of a serious non-political crime prior to his or her admission to Canada is excluded from refugee protection.
Mr. Febles filed an application for judicial review.

Monsieur Febles est un citoyen cubain ayant obtenu le statut de réfugié aux États-Unis du fait de sa crainte de persécution à titre de dissident politique. Durant son séjour aux É.-U., il a été reconnu coupable à deux occasions de voies de fait avec une arme meurtrière. Par suite de ces déclarations de culpabilité, il pouvait faire l’objet d’un renvoi des É.-U. après avoir purgé ses peines. Peu après sa libération, M. Febles est entré illégalement au Canada et a revendiqué le statut de réfugié.
Monsieur Febles a prétendu, devant la Section de la protection des réfugiés de la Commission de l’immigration et du statut de réfugié (la Commission), qu’il avait purgé ses peines, ne présentait aucun danger pour la société canadienne et était désormais réadapté. La Commission a rejeté sa demande d’asile. Elle a affirmé être liée par les dispositions législatives (art. 98 de la Loi sur l’immigration et la protection des réfugiés et la section Fb) de l’article premier de la Convention des Nations Unies relative au statut des réfugiés) et la jurisprudence, selon lesquelles est exclue du droit à l’asile la personne reconnue coupable d’un crime grave de droit commun à l’extérieur du Canada avant qu’elle y soit admise.
Monsieur Febles a déposé une demande de contrôle judiciaire.
