                   Criminal law ‑‑ Appeal as of right ‑‑ Accused convicted of criminal negligence causing death ‑‑ Conviction affirmed by a majority of the Court of Appeal ‑‑ Appeal to the Supreme Court of Canada only an invitation to review the sufficiency of the evidence ‑‑ Appeal dismissed.

 

                   APPEAL from a judgment of the Manitoba Court of Appeal (1985), 31 Man. R. (2d) 268, 19 C.C.C. (3d) 43, dismissing the accused's appeal from her conviction by Lockwood Co. Ct. J. (1983), 22 Man. R. (2d) 166, for criminal negligence causing death. Appeal dismissed.

                   The judgment of the Court was delivered orally by

 

1.                       The Chief Justice‑‑This is an appeal as of right. This is not a case of "no evidence" in support of the trial judge's findings of fact and the appeal is essentially an invitation to this Court to review the sufficiency of the evidence. This we may not do and therefore the appeal must be dismissed.
