Criminal law—Appeal—Dissenting opinion in Court of Appeal not on a point of law—Criminal Code, R.S.C. 1970, c. C-34, s. 618(1)(a).

APPEAL pursuant to s. 618(1)(a) of the Criminal Code from a decision of the Court of Appeal of Quebec[1], affirming a verdict of guilty of murder in the second degree rendered by a judge and jury. Appeal quashed.

THE COURT—The appeal is based on section 618(1)(a) of the Criminal Code.

The Court is of the opinion that the dissenting judge in the Court of Appeal did not dissent from the reasons of the majority on any question of law.

The appeal is quashed.
