JUDGMENT
The appeal from the judgment of the Court of Appeal of Yukon, Number 13-YU727, 2018 YKCA 9, dated June 13, 2018, was heard on April 23, 2019, and the Court on that day delivered the following judgment orally:
Abella J. — Applying R. v. Bradshaw, 2017 SCC 35, [2017] 1 S.C.R. 865, a majority of this panel would dismiss the appeal largely for the reasons of Dickson J.A., and Justices Karakatsanis and Brown would allow substantially for the reasons of Bennett J.A.
The appeal is therefore dismissed. |

JUGEMENT
L’appel interjeté contre l’arrêt de la Cour d’appel du Yukon, numéro 13-YU727, 2018 YKCA 9, daté du 13 juin 2018, a été entendu le 23 avril 2019 et la Cour a prononcé oralement le même jour le jugement suivant :
[traduction] La juge Abella — Appliquant l’arrêt R. c. Bradshaw, 2017 CSC 35, [2017] 1 R.C.S. 865, les juges majoritaires de la formation sont d’avis de rejeter le pourvoi, principalement pour les motifs exposés par la juge d’appel Dickson, alors que les juges Karakatsanis et Brown y feraient droit, essentiellement pour les motifs de la juge d’appel Bennett.
Le pourvoi est en conséquence rejeté. |
